Texas Supreme Court Hears Arguments in Doyle Raizner Case on Bad Faith Discovery

The Texas Supreme Court recently heard oral arguments in a workers’ compensation bad faith claim, in which the plaintiff was represented by Doyle Raizner LLP at the trial level, and on appeal by Alan Daughtry.  The plaintiff, Jerome Wagner, sued his workers’ compensation insurer, XL Specialty, after he was injured on the job and XL Specialty denied his claim, forcing him to unneceesarily proceed through the administrative process.

The matter was appealed to address a dispute in discovery about whether the attorney-client privilege attaches to communications between an insurer, its attorney, and the employer that purchased the workers’ compensation policy, while the claim is pending at the administrative level.  XL Specialty’s attorney had prepared materials and sent them to the employer–who was not XL Specialty’s client.

Mr. Daughtry prepared Mr. Wagner’s briefing on appeal and argued the case before the Texas Supreme Court.  The case was recently profiled in the Texas Lawyer Magazine.

Doyle Raizner Files Suit Against Pan American Life

On December 22, 2011, Doyle Raizner filed suit against Pan American Life Insurance Company (PALIC) and its third-party claims adminsitrator for their bad faith denial of a health insurance claim earlier this year.  After making a claim on her insurance for treatment of her recently diagnosed cancer, Pan American continued to deny the claimant’s health insurance claim, in contravention of the opinions of her doctors and the evidence that she presented to support her claim.

Doyle Raizner is proud to assist this claimant in seeking justice for the bad faith actions of Pan American.

Joplin, MO Continuing Recovery Six Months After Tornado

Yesterday marked the six-month anniversary of the May 22, 2011, F-5 tornado that touched down in Joplin, Missouri.  The tornado claimed 161 lives and destroyed huge swaths of the town.

Joplin residents obeserved the six-month mark with a memorial service at Cunningham Park, dedicating a red oak tree, fountain, and plaque to the victims of the tornado.

Meanwhile, local organizations in Joplin prepared a campaign to thank volunteers that had reached out to help the city and its residents in the wake of the tornado.  They sent cards and emails, and prepared an ad campaign to thank over 110,000 volunteers that have supported the rebuilding and recover efforts thus far.

Joplin residents and businesses are continuing to rebuild and recover from this tornado.  Many businesses and homes were completely destroyed, and even more structures suffered devastating physical damage.  In terms of the costs of damage, it may be the worst tornado on record, with an estimated cost of over $2.8 billion.

Mike Doyle Serves on Faculty for AAJ College on Communication Training

Mike Doyle taught at the college held by the American Association for Justice (AAJ) on November 11-12, 2011, in Washington, DC.  The educational program, entitled “The Persuasion Edge,” was geared toward teacing enhanced communication skills to attorneys, in order to help them select, develop, and prepare cases for trial.

Jeff Raizner and Renew Joplin Legal Team to Host Meeting on Tornado Claims and Related Insurance Issues

On Thursday November 10, 2011, Jeff Raizner will conduct a “Know Your Rights” town hall meeting in Joplin, Missouri. Jeff will be joined by Joplin attorney Patrick Martucci of Johnson, Vorhees and Martucci. The two firms are working together as part of the Renew Joplin Legal Team in an effort to assist businesses and homeowners to recover following the devastating tornado that struck Joplin on May 22, 2011. At the meeting, Jeff and Patrick will discuss common issues in insurance claims–including those arising from the May tornado–and answer questions from the community about their insurance claims.

The meeting will take place at the Joplin Family Worship Center, 5290 E. 7th Street, Joplin, Missouri.
