By order entered June 1, 2010, United States Magistrate Judge Nancy Johnson entered an order limiting KBR's ability to block access of the Department of Justice, the Office of the Department of Defense Inspector General, and Congressional authorities investigating the Qarmat Ali exposures to documents claimed as "privileged" by KBR. Rejecting KBR's attempt to remove a provision from a protective order permitting sharing with appropriate government authorities examining the KBR Qarmat Ali project and its impact on our soldiers and allied personnel at the site, Judge Johnson's Order permits any party receiving an administrative, grand jury, or other valid court subpoena to secure documents that have previously been concealed. The documents include materials from two CD's of computer files maintained by KBR's Project Manager at Qarmat Ali, Mark Daniels. Mr. Daniels revealed both the existence of these previously undisclosed CD's at his deposition, as well as his providing a copy almost three years ago to KBR's own lawyers.
