On March 30, 2010, the Honorable Katie Kennedy issued her Appraisal Opinion strongly in favor of Doyle Raizner’s client, the estate of a deceased River Oaks couple. Judge Kennedy concluded that the client’s home suffered almost $1 million in damage, as compared to the $394,920.90 partial loss found by Liberty Mutual. In issuing her Opinion, Judge Kennedy found Liberty Mutual’s hired expert, Leonard Moynahan, to be unreasonable in trying to undervalue the full damage to the home. After rejecting Liberty Mutual’s sham estimates and expert opinions, the Court found that the true damages to the home nearly doubled what Liberty Mutual offered and continued to rely upon for over a year after the tragic fire. Doyle Raizner is now proceeding with this claim in state court and intends to prevail against Liberty Mutual on its client’s claims that Liberty Mutual acted in bad faith, violated the insurance code, and committed fraud. This was an especially positive outcome for the client who was forced to endure numerous Liberty Mutual tactics, including an improper solicitation of a city official to support their undervaluing attempts.
